FINRA Suspends Former LPL Broker for Six Months

Former LPL Financial broker, Michael B. Mountjoy, agreed to a $10,000 fine and a six-month suspension from association with any FINRA member firm in all capacities.  According to FINRA Enforcement, Mountjoy engaged in a private securities transaction and two outside business activities without providing his firm with prior, written notice.   

According to a Letter of Acceptance, Waiver and Consent (“AWC”) signed by Mountjoy on April 29, 2020, Mountjoy solicited investors for a limited liability company that was formed for the purpose of investing in a minor league soccer team. Mountjoy did so without prior written notice to his firm and without his firm’s approval. Mountjoy raised $378,000 for this investment. 

FINRA Enforcement also found that Mountjoy was involved with two outside companies without providing the proper notice to his firm. FINRA found that Mountjoy was a member and treasurer of an LLC that was engaged in leasing real estate, and that Mountjoy was also a co-owner of an LLC that owned a fund designed to promote foreign investment in Kentucky and Indiana. According to FINRA, Mountjoy did not give prior written notice to LPL of these outside business activities. 

FINRA found that Mountjoy’s conduct violated FINRA Rules 2010, 3040, 3270 and 3280. By signing the AWC, Mountjoy accepted and consented to the entry of FINRA’s findings, without admitting or denying those findings.
